Civil penalties for infringement of registered copyrights is set by statute which means that we do not have to show having been harmed. Damage awards range is set by statute and are determined by the court from between $500 and $30,000 per photo, per post, and by law the copyright holder is always granted attorneys fees and legal costs. That means that the copyright infringer pays for everything. At $380/hour for our attorney, plus whatever your attorney costs, you are easily looking at bankruptcy - and declaring bankruptcy will not release you from paying damages determined by a court ordered judgment. Even at the bare minimums, 50 photos, times $500, is $25,000. Then add 100 hours at $380 per hour, and the legal fees YOU pay OUR attorney $380,000, plus whatever you pay your attorney, plus court costs.
Permitted Use. No image may be used, posted, transferred, traded or displayed by electronic or any other means without prior written permission. This includes posting to usenet/newsgroups, Yahoo and MSN groups as well as other online communities, commercial websites or not-for-profit websites. If discovered by mystmodel.com that you have infringed on our copyrights, we WILL work to find you, sue you, and extract whatever penalty is allowed by law in addition to serving summons and notices on you personally at your home and/or place of business.
Caution: If you wonder whether copyright infringement is this serious, ask ANY attorney if he/she would recommend that you take the chance of posting copyrighted photos without permission, and if there is ANY defense other than having had prior written permission. U.S. Copyright law has very few exemptions, none of which apply to your use of our photos including the "fair use" exemption which applies to news stories and published reviews.
